Which licence do we actually need – CASP, EMI, or both?
It depends on what the product does, and getting this right first saves months. Crypto-asset services – custody, exchange, transfer, running a trading platform – need a MiCA/CASP authorisation. Issuing a euro-referenced token requires an authorised e-money institution or a bank. Tokenised securities follow MiFID and prospectus rules, not MiCA. Many businesses need one licence, some need two, and the sequencing and entity structure matter. We map that fork before any file is opened.
Why Latvia for a MiCA licence?
Same EU passport, same rulebook, different process. Latvijas Banka offers a free pre-licensing stage in English before the formal filing; the application fee is €2,500, supervision runs at 0.6% of gross income with a €3,000 minimum, and the statutory review is 25 plus 40 working days on a complete file. The register is still small, so applicants get attention rather than a queue. Can you act as local counsel while our in-house team runs the application?
Yes – it is a common arrangement. The lead team drafts the file; we handle what has to happen in Latvia: correspondence and meetings with Latvijas Banka, filings in Latvian, guidance on how the requirements are applied in practice, and the substance questions – management presence, resident executive, local control of key functions – that decide whether an application succeeds. Fixed fees per workstream are available once scope is defined.
How do you work with clients outside Latvia?
Our licensing and structuring work is built for clients based elsewhere in the EU and beyond. We work remotely in English, and in person in Riga when it helps; formal filings run in Latvian, which is one of the practical reasons local counsel sits in the loop. Languages: English, Latvian, Russian.
How are fees structured?
Scope first, then price: we agree what the engagement covers and what it costs before work starts, so the invoice is never a surprise. Advisory work is billed hourly; defined workstreams – an application stage, a white paper, a structuring memo – can be fixed-fee. Every engagement begins with a conflict check. A short email describing the situation costs nothing and commits you to nothing.

Do we need a sworn advocate?
For licensing, structuring, transactions, tax and regulatory work – no. Sworn advocate (zvērināts advokāts) status is a separate regulated title in Latvia, required for certain court work but not for the advisory and regulatory work we do. Where a matter calls for it, we bring in partner advocates.
